Agreement
These terms apply to foliovip.com, the FolioVIP app and its free tools (together, “FolioVIP”), operated by Dustin Hurlbut, an individual in Washington State (“we”, “us”). By using FolioVIP you agree to these terms and to the privacy policy. If you don’t agree, please don’t use FolioVIP.
What FolioVIP is
FolioVIP is an education and information tool for viewing your own accounts, returns and budget, and for trying ideas with calculators and a demo Sandbox. It is not a broker-dealer, investment adviser or bank, it does not place trades or move money, and nothing on it is financial, investment, tax or legal advice. The disclaimer is part of these terms.
Eligibility and accounts
- You must be at least 18 years old to use FolioVIP.
- Accounts are by invitation only. Requesting an invite does not guarantee one.
- Sign-in uses passkeys. Keep the devices that hold your passkeys secure; you are responsible for activity on your account.
- Connect only accounts that you own or are authorized to view.
Free tools and future plans
The Sandbox and the budget, wealth and loan calculators are free. Paid plans or subscriptions for full accounts may be offered later. Any pricing will be announced before it applies to you, and nothing will be charged without your agreement.
Acceptable use
Please don’t:
- break the law, or use FolioVIP to harm or defraud anyone;
- try to get into accounts or data that aren’t yours, or probe, scan or test FolioVIP’s security without written permission;
- overload FolioVIP, bypass its rate limits or bot checks, or use bots to submit forms;
- scrape, copy, resell or reverse-engineer the service, except as the law allows;
- send spam, malware or other people’s personal information through the feedback or invite forms.
Third-party services
FolioVIP relies on other companies, including Plaid and SnapTrade for account connections, Massive for market prices, Render for hosting, Cloudflare for backups and bot checks, Resend for email and, when enabled, Google AdSense for ads on the free pages. Their services have their own terms, and we are not responsible for their availability or accuracy.
Our content and your data
FolioVIP’s software, design and text belong to us. You may use them only to use FolioVIP as offered. Your data stays yours; you allow us to process it only to run FolioVIP for you, as described in the privacy policy. If you send feedback, we may use your ideas to improve FolioVIP without any obligation to you.
No warranty
FolioVIP is provided “as is” and “as available”. To the fullest extent the law allows, we make no warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. Data from connected providers and market data can be late, incomplete or wrong, and calculations, estimates and projections can be wrong. Always check important figures with your bank or brokerage.
Limitation of liability
To the fullest extent the law allows, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, investments, data or goodwill, arising from your use of FolioVIP or from decisions you make based on it. Our total liability for any claim relating to FolioVIP is limited to the greater of the amount you paid us in the 12 months before the claim or US $50. Some places don’t allow these limits, so they may not fully apply to you.
You agree to cover our reasonable losses if a claim arises from your breaking these terms or the law.
Suspension and ending your use
We may suspend or close an account, or block access to the free tools, if these terms are broken, to protect FolioVIP or its users, or if we stop offering the service. Where reasonable we will tell you first. You can stop using FolioVIP and ask us to delete your account and data at any time.
Governing law
These terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Washington State, unless the law where you live requires otherwise.
Changes to these terms
We may update these terms. We will change the “Last updated” date above and, for significant changes, give notice on the site or by email. Continuing to use FolioVIP after a change means you accept the updated terms.
